Sale of Alcohol by a Child or Young Person

The Licensing (Scotland) Act 2005, Section 107 allows the sale, supply or service of alcohol by a child or young person only under the following circumstances, otherwise it is an offence: a)     where any sale by a child or young person of alcohol is for consumption off the premises (off sales),

The , Section 107 allows the sale, supply or service of alcohol by a child or young person only under the following circumstances, otherwise it is an offence:

  1. where any sale by a child or young person of alcohol is for consumption off the premises (off sales),
  2. where supply or service by a child or young person of alcohol is for consumption on the premises along with a meal supplied on the premises (on sales), and only if:

the sale, supply or service is specifically authorised by:

  1. a responsible person, or
  2. any other person of or over 18 years of age who is authorised by a responsible person

A “responsible person” in relation to licensed premises is the premises manager or other person authorised to sell alcohol on the premises.

 

Employment of Children         

There are also specific employment regulations governing the employment of children under 16 in any circumstances.
