Educational Psychology Service - Privacy Statement

A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

What information do we need? 

PվɫÇéƬ will act as the ‘Data Controller’ in regard to the personal data you provide to us. The Data Protection Officer can be contacted at the Council’s headquarters, Kilmory, Lochgilphead, PA31 8RT. The email address is: data.protection@argyll-bute.gov.uk  

The information we need to collect will include basic personal data such as name and age, however we will also need special categories of data such as medical and health conditions, additional support needs and gender. Other information may be required but we will only ask for data that is needed to help us to provide support for your child. The information may come from a variety of sources, including those people already involved with your child such as you as parents or carers, teachers and support staff at your child’s school, health professionals such as speech and language therapists and paediatricians or a social worker who knows you and your family.

We will also take in to account the views of your child or young person.

If you tell us that another professional has become involved with your child, it may be helpful to ask them if they will share any relevant information with us. 

Why we need this information

Your information is being collected for the following purpose(s):-

We need information to help us to understand the situation with which you or the school would like us to assist. We will not collect any personal data from you that isn’t needed for delivery of our services. If you do not wish to provide this information then we will be unable to offer this service to you. 

The legal basis for collecting your information in these circumstances is:

Article 6(1)(e ) – Public Task on the basis of the legal obligation placed on the Education Authority to provide Education Psychological services:

  • Education (Scotland) Act 1980 
  • Education (Additional Support for Learning) (Scotland) Act 2009
  • Scottish Schools (Parental Involvement) Act 2006
  • Standards in Scotland’s Schools etc. Act 2000
  • Children and Young People (Scotland) Act 2014

Article 9(2)(g) - special categories of data can also be collected for reasons of substantial public interest for aims that are proportionate and which contain appropriate safeguarding measures.

What we will do with your information

All of the information we collect from you will be processed by staff in the United Kingdom.  Your information will be shared with the recipients or categories of recipients detailed below:-

Other external partners including the Children’s Reporter’s Administration Where you are involved with these services, to help provide appropriate support

PARiConnect store data in the USA. We have put in place measures to ensure the information shared enjoys the same protection as it would if stored in UK.

Pearson Q-Global store data in Canada. Private companies in Canada are subject to laws that offer equivalent protection to those in the UK.

If asked to share data, educational psychologists will use their professional judgement to identify which information is appropriate and necessary to share with other professionals involved, in order to inform decision-making and assessment to support your child or young person.  We only share information which is relevant to carrying out our statutory functions.

You should also be aware that your data will be stored on servers located within the United Kingdom; except as outlined above the data will not be processed outside the European Union.  Some of the information we hold is in paper form and kept in an individual file in a locked cabinet. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this is provided on the Council website () or can be provided in paper format on request to the Principal Educational Psychologist using the contact details below.

How long will we keep your information?

We will usually keep your information until your child is 25 years old, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained.  For children and young people who are currently or have been Looked After and Accommodated by a local authority, files will be kept indefinitely in line with the requirements and recommendations of the Scottish Child Abuse Inquiry (SCAI). More information on our retention schedule is provided on the Council website ( ) or can be provided in paper format on request to your Principal Psychologist.

Your rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the legal basis specified above is consent
  • to lodge a complaint with the Information Commissioner’s Office
  • to request access to your personal data
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
  • to request rectification or erasure of your personal data, as so far as the legislation permits
