What information do we need?

All contact details Interested Parties previously supplied to the Planning Authority when their representation was made in respect of a Planning Application which is the subject of a Local Review will be collected by the Head of Governance and Law.
Unless specifically agreed with you, we will only collect personal data about you which does not include any special categories of personal information about you (also known as ‘sensitive personal data’).
Why we need this information?
Your information is being collected for the following purpose:-
We need to know the personal data in order that we can make contact with you throughout the processing of the Local Review.
We will not collect any personal data from you that isn’t needed for delivery of this service. Email addresses, telephone numbers and signatures will not be published on the Council’s website.
The lawful basis for collecting your information in these circumstances is:-
Legal obligation – processing is necessary for compliance with a legal obligation under Section 43(a)(8) of the Town and Country Planning (Scotland) Act 1997 and the Town and Country Planning (Schemes of Delegation and Local Review Procedure) (Scotland) Regulations 2013.
What we will do with your information?
If the Local Review Body request further written information from Interested Parties we will share your personal information with the Applicant and all interested parties so that they can provide you with copies of any further written information submitted and to enable you to provide copies to them of any comments you wish to make in request of any further written information submitted.
Interested parties will include the Planning Authority, statutory consultees and any other party who made a representation in connection with the application which was received prior to the Appointed Officer’s decision being reached (unless the representation was subsequently withdrawn).
All paperwork lodged in relation to a review must be made available to the public.
All of the information we collect from you will be processed by staff in the United Kingdom. You should also be aware that your data will be stored on servers located in within the United Kingdom; the data will not be processed outside the European Union. We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be requested from the Data Protection Officer.
How long will we keep your information?
We will usually keep your information for a minimum of 6 years, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained. More information on our retention policy and procedure can be obtained from the Data Protection Officer if required.
Automated Decision Making
No automated decision making will take place.
Your Rights
When you provide information to the Council, you will have the following rights:
- to withdraw consent at any time, where the lawful basis specified above is consent
- to lodge a complaint with the Information Commissioner’s Office – see below for details
- to request access to your personal data – please contact the Data Protection Officer if you wish to submit a request.
- to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
- to request rectification or erasure of your personal data, as far as the legislation permits – please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
