Blue badge privacy notice - Privacy Statement

A new data protection law was introduced on 25th May 2018. As a result, we've updated our Privacy Notice to make it easier for you to find out how we use, process and protect your information.

Your Personal Data

What information do we need?

The information we collect from you which will include details such as your name, address, e-mail address, date of birth, place of birth, National Insurance number, driving Licence number, vehicle registration number, school name (under 16鈥檚 only), proof of Identity & proof of address.

For the purposes of this specific service, the personal data we require includes special category information about you (also known as 鈥渟ensitive personal data鈥), specifically gender, benefit entitlements, medical information which includes (permanent and substantial disability, temporary but substantial disability, severely sight impaired)

Why we need this information

Your information is being collected for the following purpose(s):- to check if you meet the qualifying criteria for a Blue Badge.

We need to know this personal data in order to assess your application for a Blue Badge

If you do not provide this information then we will be unable to assess your eligibility and therefore will not be able to provide you with a Blue Badge. We will not collect any personal data from you that is not needed for delivery of this service.

The lawful basis for collecting your information in these circumstances is:-

Legal obligation 鈥 Blue Badges are governed by The Disabled Persons (Badges for Motor Vehicles) Scotland Regulations 2000 as amended. Transport Scotland is responsible for the legislation which sets out the framework for the Blue Badge Scheme and provide support to Local Authorities to help deliver this Scheme.

We are required to collect the special category information detailed above for the following reason:

  • For the provision of health or social care or treatment or the management of health or social care systems and services
  • For reasons of substantial public interest for aims that are proportionate and which contain appropriate safeguarding measures

What we will do with your information?

All documents relating to the application of a Blue Badge may be shared within the Local Authority, with other Local Authorities, Health & Social Care Partnership, Police Scotland and Parking Enforcement Officers to detect and prevent fraud. Any medical information which has been supplied to support the application of a Blue Badge is deemed as special category data and will only be disclosed to third parties as necessary for the operation and administration of the Blue Badge Scheme and to other Government Departments or agencies to validate proof of entitlement or as otherwise required by law.

When you do not provide information directly to us, we may receive it from other relevant organisations including other Council services, NHS Boards, Health & Social Care Partnership, GPs, Local Authorities; Police

All of the information we collect from you will be processed by staff in the United Kingdom.  You should also be aware that your data will be stored on servers located in within the United Kingdom; the data will not be processed outside the European Union.  We will take all reasonable steps to ensure that your data is kept securely and more information on how we do this can be requested from the Data Protection Officer.

How long will we keep your information?

We will usually keep applications for a minimum of 3 years, after this period it will be destroyed under secure arrangements if it is no longer required for the lawful purpose for which it was obtained. More information on our retention policy and procedure can be obtained from the Data Protection Officer if required.

Automated Decision Making

No automated decision making will take place.

Your Rights

When you provide information to the Council, you will have the following rights:

  • to withdraw consent at any time, where the lawful basis specified above is consent
  • to lodge a complaint with the Information Commissioner鈥檚 Office 鈥 see below for details
  • to request access to your personal data 鈥 please contact the Data Protection Officer if you wish to submit a request.
  • to data portability, where the Legal basis specified above is i) consent or ii) performance of a contract
  • to request rectification or erasure of your personal data, as far as the legislation permits 鈥 please contact the Data Protection Officer and provide details of what data you wish to be rectified or erased.
